COVID 19 Update

March 18, 2020:  Licensure flexibility in new executive order; New guidance on visitor policy; Letter to Congress

This evening, Gov. Cuomo issued a new Executive Order<https://urldefense.proofpoint.com/v2/url?u=http-3A__www.mmsend10.com_link.cfm-3Fr-3DzeNuLO1b1D87W5zMysUEWQ-7E-7E-26pe-3DQzHVoBEUSn3d-5FPGWU2TyLZtW8zsOYB0tdZ-2DNBT-2D2hh0dl24BdOh1c-5FO0C2dGFxEBwTiRfFep7PNfMPcXR3UeMQ-7E-7E-26t-3D6AdIA6RlJooCjEkm7iGcSQ-7E-7E&d=DwMFaQ&c=jNvQucITcQMsdvTsVf6FpQ&r=CxTx_9ON1SvhnZnOJd0leg&m=B_Kyjv-wkATfGkY-iy4kOSN1QtmB6Dri9QSFtXg6KJc&s=smVyt4Pgwb0TUbC-y5lchqftcP7yUefaF8yAk39b1gg&e=> that includes many waivers for which HANYS advocated strongly. These waivers will allow for more flexibility when responding to COVID-19:
>  *   allows physicians, physicians' assistants, nurse practitioners, registered nurses and licensed practical nurses who are licensed and in good standing in any state to practice medicine in New York without civil or criminal penalty related to lack of licensure or registration with the state;
>  *   provides for the rapid transfer and admission of an individual from a hospital into a nursing home by allowing nursing homes more flexibility in the timeframe for patient assessments and physician approvals, to be done as soon as practical, or to forgo such assessments for individuals who are returned to facilities from which they originated;
>  *   allows staff with the necessary professional competency who are privileged and credentialed to work in a facility within any state to practice in a New York state facility;
>  *   provides for the applicability of current minimum standards of practice for hospitals as established by DOH regulation to new temporary facilities established for the purpose of treating patients during the COVID-19 outbreak; and
>  *   removes requirements relating to the allowable communications and visitation of patients in OMH/OASAS/OPWDD facilities to comply with current visitor restrictions, without penalty.
> DOH released new guidance directing hospitals to suspend all visitation<https://urldefense.proofpoint.com/v2/url?u=http-3A__www.mmsend10.com_link.cfm-3Fr-3DzeNuLO1b1D87W5zMysUEWQ-7E-7E-26pe-3DidoQFC9VEntDxGNfQvB6QopvVo2YHM8SiMq-2DOtv4TjmNN8GeAQqCkuaOWYcAmgW1-2DzuD8hDYdciq7cacGou2sg-7E-7E-26t-3D6AdIA6RlJooCjEkm7iGcSQ-7E-7E&d=DwMFaQ&c=jNvQucITcQMsdvTsVf6FpQ&r=CxTx_9ON1SvhnZnOJd0leg&m=B_Kyjv-wkATfGkY-iy4kOSN1QtmB6Dri9QSFtXg6KJc&s=-pIirBTatdQPw1U_lTN2UlBBzuC-cOG6i3fkPocgd64&e=> except when medically necessary or for family members or legal representatives of patients in imminent end-of-life situations.
